Terms of Use
App: ToVue (the “App”)

These Terms of Use (the “Terms”) set out the conditions for using the App provided by ToVue (“we”, “us”). By downloading, installing or using the App, you agree to these Terms.
Article 1 (Scope)
- These Terms apply to all matters between you and us relating to the use of the App.
- Because the App is distributed through the Apple App Store, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies. Where these Terms and the Standard EULA conflict, these Terms prevail for matters specific to the App.
Article 2 (Definitions)
- “Service” means the App’s features for moving a virtual camera over 3D maps and saving or sharing the map as photos and videos.
- “User” means anyone who uses the App after agreeing to these Terms.
- “Captures” means the photos and videos a User creates with the App.
- “Paid Content” means the features unlocked by the one-time purchase “Remove Ads & ToVue Logo”.
Article 3 (Nature of the App)
- The App is a virtual sightseeing app that moves a virtual camera over Apple Maps (MapKit) maps, imagery and 3D buildings. It does not connect to or control any real drone, aircraft or other device.
- The App must not be used for surveying, navigation, aviation, flight planning, safety checks or any other real-world decision.
- Positions, altitudes and place names shown in the App are approximations based on map data. Altitude is the height of the virtual camera, not a measured height above the ground.
Article 4 (Map Data and Connectivity)
- Map imagery, 3D buildings, search results and place names are provided by Apple and may be incomplete, outdated or unavailable in some areas.
- The App requires an internet connection. Data charges are your responsibility; faster flight tends to load more map data.
Article 5 (Captures)
- Captures are drawn on your device from the App’s map view. Apple Maps attribution always stays on them.
- Without the Paid Content, Captures include a small ToVue logo.
- Whether Captures include the place name, coordinates and altitude, the control sticks or the mini map is chosen in the menu settings.
- When sharing or publishing Captures, you must follow applicable laws and the map provider’s attribution and usage terms. Do not remove or hide the map attribution.
Article 6 (Advertising)
- The free version may show a Google AdMob banner in a dedicated strip above the map.
- Right after you move to a new place through search or the map picker, a full-screen ad may be shown, at most once every few minutes. Full-screen ads are never shown while you fly with the sticks and can always be closed.
- Captures never contain ads.
- Information relating to advertising is handled under our separate Privacy Policy.
Article 7 (Paid Content)
- “Remove Ads & ToVue Logo” is a one-time, non-consumable in-app purchase. It is not a subscription.
- Once the purchase is verified, all ads (banner and full-screen) stop, and you can switch off the ToVue logo on Captures made afterwards. Apple Maps attribution is never removed.
- All payments are processed by Apple (App Store), and the price is shown in the App Store before you buy. We do not receive or store credit card numbers or other payment details.
- You can restore the purchase with “Restore Purchases” on a device signed in with the same Apple Account.
- Refunds: refunds are handled by Apple under Apple’s refund policies. We cannot issue refunds for payments made through Apple. If a purchase is refunded or revoked, ads and the ToVue logo return.
- Prices and contents may change without notice. Purchased content is handled under the conditions in effect at the time of the change.
Article 8 (Conditions of Use and Prohibited Conduct)
When using the App, you must not:
- Violate laws or public order and morals
- Infringe the rights or interests of us, other users or third parties
- Use the App for real flight, navigation, surveying or other safety-related decisions
- Remove or alter the map attribution in Captures, or use Captures in a way that violates the map provider’s terms
- Reverse engineer, decompile, modify or otherwise analyze the App (except as permitted by law)
- Exploit defects or vulnerabilities of the App, or manipulate ads fraudulently
- Use the App in a way that violates the terms of Apple, Google or other third-party services
- Engage in any other conduct we reasonably consider inappropriate
Article 9 (Intellectual Property)
- Intellectual property rights in the App and its software, design and trademarks belong to us or the rightful owners.
- Rights in map imagery, 3D buildings, place names and other map data belong to Apple and its data providers. These Terms do not transfer or license those rights to you.
Article 10 (Disclaimers)
- The App is provided “as is”. We do not warrant that it is complete, accurate, useful, fit for a particular purpose, or free of errors or interruptions.
- Maps, positions, altitudes and place names come from Apple’s map data. We are not responsible for their accuracy or timeliness.
- Recording smoothness and quality depend on your device, settings and connection.
- Changes, outages or discontinuation of Apple, Google or other third-party services may make all or part of the App unavailable.
Article 11 (Limitation of Liability)
- We are not liable for damages arising from the use of, or inability to use, the App, except in cases of our intent or gross negligence.
- Where we are liable, our liability is limited to the amount you paid us for the App in the preceding 12 months.
- Where consumer protection laws or other mandatory laws apply, this Article applies only to the extent those laws permit.
Article 12 (Changes, Suspension and Termination)
We may change the App, or suspend or end its provision, without prior notice. We are not liable for resulting damages beyond the scope of these Terms.
Article 13 (Third-Party Services)
The App uses services from Apple (maps, place search and in-app purchases) and Google (AdMob advertising and consent management). Their own terms and policies apply to those services.
Article 14 (Privacy)
Your information is handled under our separate Privacy Policy.
Article 15 (Changes to These Terms)
We may change these Terms when we consider it necessary, without notifying you. Significant changes will be announced on this page. If you continue to use the App after a change, you are deemed to agree to the changed Terms.
Article 16 (Governing Law and Jurisdiction)
- These Terms are governed by the laws of Japan.
- Any dispute between you and us relating to the App is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
